Terms & Conditions
These terms are the agreement between you and us about using Nitick. Please read them. By creating an account or using the app you agree to them. If you do not agree, please do not use Nitick.
1. Who we are
Nitick is provided by [[COMPANY LEGAL NAME]], [[COMPANY ADDRESS]] (“we”, “us”). “Nitick” means our Android app and this website. How we handle personal data is explained in our Privacy Policy, which forms part of these terms.
2. Who can use Nitick
You must be at least 18 years old and able to enter into a binding agreement. You must not use Nitick if we have previously closed your account for breaking these terms, or if the law in your country forbids it.
3. Your account
- Give accurate information, and use one account for yourself only. Do not pretend to be someone else.
- Keep your password private. You are responsible for what happens under your account. There is currently no password reset, so if you lose your password we may not be able to recover the account.
- Tell us straight away if you think someone else has used your account.
4. How Nitick works, and staying safe
Nitick uses Bluetooth to notice other Nitick users near you and lets you look back later at who you crossed. You decide whether to say hello, what to show on your profile, and whether to accept a request.
Nitick is a way to be introduced. We do not check who people are or run background checks, and we cannot promise that a profile is truthful or that another user will behave well. Please use judgement: be careful what you share, meet new people in public places, tell someone where you are going, and leave if you feel uncomfortable. You can block or report anyone at any time.
5. Rules of use
When you use Nitick you must not:
- harass, threaten, stalk, shame, or discriminate against anyone, or send unwanted sexual content;
- post or send anything illegal, hateful, violent, or that exploits or endangers a child;
- impersonate a person or organisation, or give a false age or identity;
- use Nitick to track, locate or follow a person who does not want to be found, or to collect information about people;
- advertise, spam, scam, solicit money, or sell anything;
- share another person's private information without their permission;
- copy, scrape, reverse-engineer or interfere with the app or our servers, bypass its safety limits, or use bots or automation;
- upload malware, or try to get into accounts or systems that are not yours;
- use Nitick for anything unlawful, or help anyone else do any of these things.
6. Your content
Your nickname, photo, profile details and messages are your content, and they stay yours. To run Nitick we need your permission to store, copy, display and deliver that content to the people you chose to share it with, and to review it where this is needed for safety (see below). You give us that limited permission for as long as the content is on Nitick. You promise you have the right to share what you post, and that it follows these terms.
Other users may take screenshots or copy what you share with them. Only share what you are comfortable with.
7. Reports and enforcement
You can report people and messages inside the app. We may review reported content together with nearby messages, remove content, limit features, suspend or close accounts, and tell the authorities where the law requires or someone may be in danger. We try to act fairly, but we are not obliged to monitor everything users do, and we may act without notice when safety requires it.
8. Early-access builds
Some versions of Nitick, including builds downloaded from our website, are early-access releases. They may contain errors, change or stop working, or need data to be reset. You use them at your own risk, and we welcome your feedback through the contact form.
9. Our rights
Nitick, its name, logo, design and code belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on your own Android device for its intended purpose. You may not copy, sell, rent, or create derivative works from it, except as the law allows.
10. Changes, availability and ending
We may change or stop features, and update these terms. If a change matters we will tell you in the app before it applies; if you keep using Nitick afterwards you accept it. We aim to keep Nitick available but do not promise it will always work without interruption.
You can stop using Nitick at any time and delete your account in the app (Profile → Delete account; see also the delete account page and the Privacy Policy). We may suspend or end your account if you break these terms, if we must by law, or if we stop offering Nitick.
11. Disclaimers
Nitick is provided “as is” and “as available”. To the fullest extent the law allows, we do not make promises about its quality, reliability or fitness for a particular purpose, or that Nitick will find any particular person, or that you will meet or make friends with anyone. We are not responsible for what users say or do, online or in person.
12. Limit of liability
Nothing in these terms limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or for fraud). Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, data or goodwill, or for anything caused by other users, third-party services or events outside our control. Our total liability for any claim relating to Nitick is limited to [[LIABILITY CAP, FOR EXAMPLE THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS OR A FIXED SUM]].
13. Governing law
